This Privacy Policy explains how Barbara Clarke Photography (“we”, “us”, “our”) collects, uses and protects personal information when you visit www.barbaraclarkephotography.com, buy a print from our online shop, or contact us through the site.

Barbara Clarke Photography is based at 1A Monohansett Rd., Nantucket, MA 02554, United States.

This policy covers this website and our online shop. Portrait, wedding, event and real estate photography sessions are covered by the separate agreement you sign when you book.

Information we collect

When you place an order. We collect your name, billing and shipping address, email address, phone number, the items you order and your order history. Payments are handled by Stripe. We never see or store your full card number.

When you create an account. If you create a customer account, we store your login details, saved addresses and past orders.

When you contact us. Our contact form asks for your name, email address, phone number, the type of service you are interested in, a subject and your message. We receive this by email.

Automatically, when you browse. Like most websites, our server and security tools record technical information such as your IP address, browser type and the pages you request. If you agree to analytics cookies, we also collect information about how you use the site. See “Cookies and analytics” below.

We do not ask for sensitive information such as health, financial account or government ID details.

How we use your information

We use your information to:

  • Process, produce, ship and support your orders, including order and shipping emails
  • Reply to your inquiries and booking requests
  • Prevent fraud and keep the site secure
  • Understand how visitors use the site, but only if you agree to analytics cookies
  • Keep business, tax and accounting records
  • Meet our legal obligations

We do not send marketing emails unless you ask us to. We do not use your information to make automated decisions about you.

For visitors in the European Economic Area or the United Kingdom, our legal bases are: performing our contract with you (orders), our legitimate interests (answering inquiries, security, fraud prevention), your consent (analytics and advertising cookies), and legal obligations (tax records).

Cookies and analytics

We ask for your consent before setting any non-essential cookies. When you first visit, a banner lets you accept all, reject all, or choose by category. Until you choose, only necessary cookies are used. You can change your choice at any time through the Cookie Settings link on this page or the round button at the bottom left of every page.

Necessary cookies keep the site working. They remember your cart and cookie choices, keep you signed in to your account, and help prevent fraud and spam. These cannot be switched off.

Analytics cookies are used only if you accept them. We use Google Analytics to see which pages are visited and how people find the site. With your consent, Google Analytics also uses Google Signals, which lets Google connect this data to signed-in Google accounts for reporting and advertising features. WooCommerce also records how you arrived at the site (for example from a search engine or social media) so we know which channels lead to orders.

Advertising cookies are used only if you accept them. We do not currently run advertising on this site beyond the Google Analytics features described above.

For a full, current list of the cookies we use, open Cookie Settings and expand each category. It shows each cookie’s name, purpose and how long it lasts.

You can also block or delete cookies in your browser settings. Blocking necessary cookies may stop the cart and checkout from working.

Do Not Track. Our site does not respond to browser “Do Not Track” signals, because there is no common standard for them. Instead, no analytics or advertising cookies are used unless you accept them in our cookie banner.

The site uses HTTPS encryption, security monitoring and regular software updates. Card payments are handled by Stripe, so card numbers never pass through our server. No system is perfectly secure, but we work to protect your information.

Children

Our online shop is not directed to children under 13, and we do not knowingly collect their personal information online. Bookings for children’s or student portraits are made by a parent or guardian.

Visitors outside the United States

We are based in the United States, and our service providers may store and process information in the United States and other countries. Where required, these transfers are protected by safeguards such as the EU-US Data Privacy Framework or standard contractual clauses.

Your rights and choices

Wherever you live, you can ask us to:

  • Tell you what personal information we hold about you and give you a copy
  • Correct information that is wrong
  • Delete your information, unless we must keep it for legal, tax or fraud prevention reasons
  • Stop using your information for analytics, by changing your cookie choices

If you are in the European Economic Area or the United Kingdom, you can also object to or restrict certain uses, ask to move your data to another service, and withdraw consent at any time. You may complain to your local data protection authority. California residents and residents of other US states with privacy laws may have similar rights under their state’s law.

To make a request, contact us using the details below. We will respond within 30 days and may need to confirm your identity first. We will not treat you differently for using your rights.
